Unlikely. The parties are talking, and VNI will participate in the settlement process in good faith. The case has been referred to the Southern District of New York’s Mediation Program, and the first mediation session is scheduled for August 12, 2026. The court’s procedures expressly contemplate that mediation may resolve all issues, some issues, or no issues at all.In May 2026, VNI President Greg Sharp met for approximately two hours with Schumacher Chief Financial Officer Antonella Pilò, Senior Manager of Business and Legal Affairs Casey Saladino, and archivist Kristen Robinson. The participants discussed the histories of Vera and Schumacher and acknowledged that continued litigation could end a relationship spanning more than 75 years.Near the end of the meeting, Sharp asked whether Schumacher had interviewed Cristina Buckley, whose published account explains how she located Birches in Schumacher’s archive and reintroduced it in the 2005 Decorator’s Walk collection. According to VNI’s recollection, Saladino responded, in substance:“No, because we think we know how this happened.”VNI does not contend that this statement, standing alone, proves infringement or determines ownership. It is nevertheless significant because the response was not simply that Schumacher possessed an ownership document or had no reason to investigate. It suggested that Schumacher believes it knows how the 2005 release occurred. Discovery should reveal what Schumacher believes happened, who was involved, what records support that understanding, and whether that history is consistent with Schumacher’s present legal position.The meeting did not resolve the central disagreement. VNI recalls Pilò stating that Schumacher believed it owed VNI nothing because Schumacher claimed to own the designs. VNI continues to dispute that position and has requested an assignment, purchase agreement, work-for-hire agreement, bill of sale, or other documentation establishing Schumacher’s ownership.Earlier written communications further complicate the issue. In September 2024, Schumacher sought to purchase the full intellectual-property rights to Large Open Boxes, Wild Things, and Square Dance, while proposing to continue selling the remaining Vera collection and paying royalties. Then, on December 17, 2024, Lauren Ilsley wrote that Schumacher’s legal team had approved an email agreement providing:“Schumacher sell-out period extending until all inventory is sold out” “Schumacher to continue to pay current royalty (5% of net sales)”“Vera to retain ownership of all designs” “Designs become non-exclusive to Schumacher as of January 1, 2025.”VNI understood that language according to its ordinary meaning. Schumacher may now argue that “all designs” referred only to designs expressly included in the 2018 licensed collection. That apparent conflict is another issue that may require discovery or adjudication. Nevertheless, VNI agreed to extend the selloff period and has complied with the written agreement.Could some issues settle?Yes. VNI believes mediation could potentially resolve some of the parties’ disputes, including matters involving:royalty reporting and accounting;obligations under the 2018 license;attribution and copyright notices;the extended sell-off period;remaining inventory; andthe treatment of particular designs.A partial resolution would not be unusual. The SDNY Mediation Program specifically recognizes outcomes in which agreement is reached on some, but not all, issues.What about the core copyright dispute?VNI does not presently expect the central copyright-ownership question to be resolved through a payment-only settlement.For VNI, this case is not solely about the amount of unpaid royalties, interest, and claimed ownership. It concerns whether a company may retrieve an artist’s work from an archive, remove or replace its attribution, claim the work was recently created as a work made for hire, and then require the artist’s successor to disprove that claim decades later.VNI views the case as an opportunity to encourage stronger industry practices:verify chain of title before releasing archival designs;distinguish possession of artwork from ownership of copyright;obtain written assignments or licenses;properly credit artists;compensate artists and their successors; andcorrect ownership claims when supporting documentation cannot be produced.
Where Schumacher or any other company cannot substantiate ownership of an artist’s work, VNI believes the appropriate response is to correct the record and return the rights—not offer to sell disputed rights back to the artist or the artist’s successor.So, will the case settle?The honest answer is:A negotiated or partial resolution remains possible, and VNI will approach mediation seriously. What Is “Fraud on the Copyright Office”?

“Fraud on the Copyright Office” is a phrase sometimes used when a copyright applicant is accused of knowingly providing materially false information to obtain a registration.The phrase should be used carefully. A copyright registration is not automatically fraudulent merely because it contains incorrect information. Federal law distinguishes among:an innocent mistake;a misunderstanding of the facts or law;negligent recordkeeping;a knowingly false statement; anda knowingly false statement that was material to the Copyright Office’s decision to register the work.
The Copyright Office generally does not conduct an independent investigation to confirm the truth of every factual statement in an application. It principally relies on the applicant’s certification and examines whether the submitted work and application satisfy the registration requirements. Disputes over authorship and ownership are ordinarily resolved in federal court.VNI looks forward to deposing Dara Caponigro, Pamela Marshall, Susan North, Avodica Ash, and other relevant Schumacher witnesses. North spent approximately sixteen years at Schumacher, joining in 1997 and ultimately serving in senior design and creative-director roles; she also directed design personnel for Schumacher, Greeff, and Decorators Walk during the period surrounding the 2005 reintroduction of Birches. She is now Creative Director at Scalamandré.  Ash was publicly identified as the Schumacher archivist before she certified Schumacher’s 2015 Birches copyright application, which listed Schumacher as the author, stated that the work was made for hire, and supplied the 2004 creation date.   Discovery should establish who selected and reintroduced Birches, who researched its history, who supplied the facts in the copyright application, and how Schumacher’s present ownership theory developed.What does the law require?There are two related—but separate—legal paths.The civil registration issueUnder 17 U.S.C. § 411(b), a registration ordinarily remains effective even if it contains inaccurate information. To undermine the registration on this ground, it must be shown that:inaccurate information was included in the application;the applicant knew the information was inaccurate; andthe Copyright Office would have refused registration had it known the truth.When those issues are properly raised in an infringement case, the court asks the Register of Copyrights whether the accurate information would have caused the Office to refuse registration. The Register advises the court on that registration question; the court ultimately determines the legal consequences.The separate criminal provisionFederal law also makes it an offense to knowingly make a false representation of a material fact in a copyright application or a written submission connected with it. VNI’s complaint identifies Vera’s Birches as the subject of Copyright Registration No. GP 121966 and alleges that Schumacher later removed or replaced Vera-related copyright-management information.Schumacher, however, denies wrongdoing and now asserts that Vera created the disputed designs for Schumacher with the intention that Schumacher own them. Schumacher also relies upon its 2015 registration as evidence of ownership.Does the registration prove fraud?No.The registration proves what Schumacher represented to the Copyright Office in 2015. Schumacher & Co.According to VNI’s recollection of an in-person meeting with Schumacher in approximately May or June 2026, Chief Financial Officer Antonella Pilò opened the discussion by apologizing on Schumacher’s behalf for what she characterized as a lack of professionalism. Pilò stated, in substance, that they should have telephoned VNI to discuss the issue rather than sending the April 8, 2025 email.Was Schumacher objecting merely to the tone and method of Carrie’s communication, or was it also disavowing the substance of the ownership positions she documented?Carrie’s email was not presented as an unsupported personal opinion. She expressly stated that Schumacher had consulted its Creative Director and former Studio Design Director and that its conclusions were based on those conversations. The email then set out Schumacher’s positions regarding collaboration, sole authorship, archive location, and ownership.Carrie’s subsequent departure does not erase that contemporaneous record. Business-and-legal operations professionals can coordinate internal investigations, gather records, manage outside counsel, communicate corporate positions, and help executives evaluate risk.But it does raise questions about authority and review:Was Casey communicating business positions, legal positions, or both?Who provided the legal analysis underlying those positions?Did she have authority to modify Schumacher’s position?What information did she receive from the archive?What conclusions did she receive from Dara and Pam?What was escalated to the CEO, CFO, or board?Who authorized the position communicated to VNI?Who had authority to resolve the dispute before litigation?What role did Schumacher’s in-house legal leadership play in reviewing the 2015 copyright filing, the 2018 Vera license, the archive-origin theory, and the positions later communicated to VNI?Kristen RobinsonArchivist for FS&COKristen Robinson is Schumacher’s archivist.In company-produced material, Robinson describes an archive containing approximately 40,000 textiles, 1,500 wallpaper books, historical ledgers and records, a reference library, and original artwork accumulated over Schumacher’s long history.That makes her role central to the factual investigation.The 2025 correspondence shows that Kristen was copied on the relevant discussions and that Schumacher said its “legal team and our archivist” had reviewed historical ownership and copyright-filing practices.Kristen should not be treated as the person responsible for making Schumacher’s legal decisions.
